By accessing our app, Thinking Of U (“the platform”), you are agreeing to be bound by these terms of service (collectively, the “Services” or the “Terms”), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing TOU*. The materials contained in TOU are protected by applicable copyright and trademark law.

Who May Use the Services

You must be at least 13 years old to use the platform. By using the platform, you agree that:

• You are forming a binding contract with TOU and are not a person barred from receiving services under the laws of the applicable jurisdiction.
• You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
• If you are using the platform on behalf of an organisation or entity, you are authorised to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” in these Terms refer to such entity.

Use License

Permission is granted to temporarily download one copy of TOU per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained in TOU; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by TOU App Ltd at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

The materials within TOU are provided on an ‘as is’ basis. TOU App Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, TOU App Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to TOU.

Limitations

In no event shall TOU App Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use TOU, even if TOU App Ltd or a TOU App Ltd authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of Materials

The materials appearing in TOU could include technical, typographical, or photographic errors. TOU App Ltd does not warrant that any of the materials on TOU are accurate, complete or current. TOU App Ltd may make changes to the materials contained in TOU at any time without notice. However, TOU App Ltd does not make any commitment to update the materials.

Content

TOU reserves the right to review or remove all content that appears on the platform. TOU may take punitive action against any account that posts content that is in violation of our Community Guidelines.

All content on TOU is the sole responsibility of the person or organisation that submitted it. Although TOU reserves the right to review or remove all content that appears on the platform, we do not necessarily review all of it. As a result, we do not take responsibility for any content that others provide through our platform.

Rights you grant us

You retain your rights to any content you submit or post on the platform. Additionally, by using our Services, you grant us a license to use that content (if your settings require). By submitting or posting content on the platform that is intended to be public (for example your ‘Legaci’, you hereby grant to TOU a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, copy, reproduce, publish, adapt, distribute, modify, publicly display, and create such content in any and all media or distribution methods now known or later developed. This includes TOU’s ability to use this content for service providers or third parties that support our Services, as well as allowing TOU to use this content to provide, promote, and improve the Services.

Your account

You may need to create an account to use some of our Services on the platform. It is your sole responsibility to safeguard your account, so we advise you to actively protect your login credentials. TOU is not liable for any loss or damage associated with your failure to protect your account.

TOU App Ltd has not reviewed all the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TOU App Ltd of the site. Use of any such linked website is at the user’s own risk.

Modifications

TOU App Ltd may revise these terms of service for its app at any time without notice. By using TOU you are agreeing to be bound by the then current version of these terms of service.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of New Jersey and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

General

• We reserve the right to alter these terms at any time
• We reserve the right to deny access to the platform to anyone for any reason at any time
• We reserve the right to force forfeiture of any username for any reason at any time
• You may end your legal agreement with TOU by deleting your account and discontinuing your use of the platform

How to Delete Account
